我国立法文本翻译中shall 一词滥用常引起争议,有些学者对其使用中存在的问题也做了一些探讨,并提出了一些相应的处理措施｡然而多年来这些研究成果并未在翻译实践中引起译者的重视｡为了彻底扭转我国立法文本翻译中shall 的滥用,本研究以翻译规范论为出发点,客观､深入地分析shall 在我国立法文本翻译中使用的失范情况和形成原因,并在此基础上结合立法文本翻译工作的具体情况提出可行的改进方案｡

The word “shall” is widely used in legislative text translation in China and often results in disputes. Though the use of “shall” has been criticized by some scholars for a long time, no obvious changes occur in legislative text translation practice. On the basis of norm theory, a thorough analysis of the reasons for using “shall” is carried out and the potential negative influence is discussed. Finally, on the basis of translation practice, feasible methods are proposed to avoid using “shall” in translating legislative texts.
